Of the 50 states, Nebraska is one of only 25 which specifically authorizes payday loans. Of course like all states which authorize payday loans or instant cash advances, lenders are required to be licensed by the state, specifically from the Nebraska department of Banking. Lenders are required to provide the state with some information, including the name of the business, location and disclose any misdemeanors involving felonies. In addition to application fees, each payday lender must adhere to a public hearing for their license.

A payday lender may only charge $15 interest for each $100 borrowed. The term of a loan may not exceed 31 days and the loan may not be higher than $500. Meaning that the maximum amount a lender may charge for a loan of $500 is $75. Borrowers in the state of Nebraska may also not lend more than two checks at a time. Those two checks can not exceed $500. Although lenders cannot exceed the $75 fee, if a borrower is late on their payments, a payday lender can charge a one time penalty  of 15%.

Payday lenders are required to display their license in plain view, as well as a schedule of fees, clearly stating what a borrower would be paying per loan. A written loan agreement must also be presented to the lender, stating the terms of the loan as well as the date the check will be deposited.
